Vatican tries to draw line under clerical sex abuse scandals at UN hearing


The Vatican has been given another hostile interrogation by a United Nations committee over its record on clerical sex abuse.
One member after another of the committee against torture brushed aside the Holy See's argument that its obligation to enforce the UN convention against torture stopped at the boundaries of the world's smallest country, the Vatican City state. They demanded the pope's representative give answers to a long list of questions about the treatment of sex abuse claims against clergy throughout the world.
The Holy See, which long predates the city state, is a sovereign entity without territory. It is as the Holy See that the Catholic leadership maintains diplomatic relations and signs treaties such as the convention against torture.
But Archbishop Silvano Tomasi, the Vatican's UN ambassador in Geneva, told the committee: "The Holy See intends to focus exclusively on Vatican City state."
The American expert on the committee, Felice Gaer, made plain her disagreement. She said the Holy See had to "show us that, as a party to the convention, you have a system in place to prohibit torture and cruel, inhuman and degrading punishment when it is acquiesced to by anyone under the effective control of the officials of the Holy See and the institutions that operate in the Vatican City state".

As expected, a Holy See delegation faced tough questioning at the UN’s Committee Against Torture in Geneva yesterday. For the second time in three months, the Vatican was appearing before a UN body to answer questions about its ratification of a UN treaty, especially with regard to is past, present and future handling of clerical sex abuse.
In his opening address to the committee, Archbishop Silvano Tomasi, the Holy See’s permanent representative at the UN in Geneva, argued that while the Holy See lent “its moral support and collaboration . . . to the elimination of torture”, it had signed the torture convention in 2002 “on behalf of the Vatican city state”.

No jurisdictionArchbishop Tomasi said he intended to “focus exclusively on the Vatican city state”, the 100 -acre statelet that surrounds the Basilica of St Peter’s.
In that sense, he claimed, the Holy See had “no jurisdiction over every member of the Catholic Church”. Rather, he said, persons who “live in a particular country are under the jurisdiction of the legitimate authorities of that country and are thus subject to the domestic law [of that country]”.

Inevitably, that assertion prompted a critical reaction from the UN committee, with US human rights activist Felice Gaer accusing Archbishop Tomasi of making an “alleged distinction” between the Holy See and the Vatican city state.
She questioned the Holy See’s apparent assumption that the torture convention applied only to the “four corners of Vatican City”, saying that as far as she could see, Vatican City was simply a “sub-division” of the Holy See.

VATICAN CITY (AP) — The Vatican is gearing up for a bruising showdown over the global priest sex abuse scandal, forced for the first time to defend itself at length and in public against allegations it enabled the rape of thousands of children by protecting pedophile priests and its own reputation at the expense of victims.
The Holy See on Thursday will be grilled by a U.N. committee in Geneva on its implementation of the U.N. Convention on the Rights of the Child. Among other things, the treaty calls for signatories to take all appropriate measures to protect children from harm and to put children's interests above all else.
The Holy See ratified the convention in 1990 and submitted a first implementation report in 1994. But it didn't provide progress reports for nearly a decade, and only submitted one in 2012 after coming under criticism following the 2010 explosion of child sex abuse cases in Europe and beyond.
Victims groups and human rights organizations teamed up to press the U.N. committee to challenge the Holy See on its abuse record, providing written testimony from victims and evidence outlining the global scale of the problem. Their reports cite case studies in Mexico and Britain, grand jury investigations in the U.S., and government fact-finding inquiries from Canada to Ireland to Australia that detail how the Vatican's policies, its culture of secrecy and fear of scandal contributed to the problem.
Their submissions reference Vatican documents that show its officials knew about a notorious Mexican molester decades before taking action. They cite correspondence from a Vatican cardinal praising a French bishop's decision to protect his abusive priest, and another Vatican directive to Irish bishops to strike any mandatory reporting of abusers to police from their policies. The submissions even quote the former Vatican No. 2 as saying bishops shouldn't be expected to turn their priests in.
"For too many years, survivors were the only ones speaking out about this and bearing the brunt of a lot of criticism," said Pam Spees, an attorney at the Center for Constitutional Rights, which provided a key report to the committee. "And so this is a very important moment for many, many people who are here in Geneva and around the world who will be watching as the Holy See is called for the first time ever to actually answer questions."

We've reached the backlash-to-the-backlash stage with Anthony Weiner.
Ari Melber writes in the Daily News that calls for Weiner to exit the New York mayor race after new sexting revelations are "wrong, anti-democratic and strangely puritanical."
Andrew Sullivan, Dan Savage and Amanda Hess have all been noting that sexting with strangers is increasingly common behavior with the rise of smartphones, and sooner or later we'll have to make peace with electing leaders whose sexts we have read.
In the abstract, they're right. Let's be frank. In the age of Grindr, I'm far from the only gay man under 35 with a personal stake in changing this norm.
But while we will eventually need a standard bearer for the "sexters can be leaders, too" message, Weiner can't be it. That's because the specific circumstances of his sexting provide further evidence that he lacks the temperament to be a good mayor.
Let's look back at Exhibit A on Why Anthony Weiner Would Be A Terrible Mayor: June's New York Times piece on his record in Congress.
The Cliffs Notes version: Weiner had no record of legislative accomplishment to speak of, save for one pet bill pushed by a major donor. His main goal seemed to be to get on television as much as possible and raise his profile for a run for mayor.
He positioned himself as a progressive champion but was not useful in getting the left's goals into law. He threatened to interfere with passage of Obamacare but relented when Nancy Pelosi put him in a position to take more credit for it. He went on a self-aggrandizing rant against Rep. Peter King (R-N.Y.) at the same time other New York Democrats were working constructively with King to secure passage of a bill to compensate 9/11 first responders. He refused to participate in a pro-immigration event because its organizers wouldn't make it into a platform for showcasing Anthony Weiner.

Two More Reasons To Think Anthony Weiner Is A Sociopath

Anthony Weiner is terrible for so many reasons that I accidentally left two big ones out of my Weiner-must-go piece this morning.
One is a story the New York Daily News had over the weekend: In 2011, before his abject apology to his wife and the public for sexting and then lying about sexting, Weiner spent $45,000 from his campaign fund to hire a private investigator to find out who had "hacked" his Twitter account and sent a photo of a crotch. (Of course, Weiner sent the photo himself.)
The other goes back to Weiner's first political campaign, his successful 1991 run for city council. In the week before the Democratic primary, Weiner's campaign sent out an anonymous mailer accusing an opponent, Adele Cohen, of supporting the "Dinkins/Jackson agenda."
The mailer went out shortly after the Crown Heights riots, which arose from tensions between blacks and Hasidic Jews in Brooklyn. The reference to the Rev. Jesse Jackson and then-Mayor David Dinkins was an obvious race-based appeal to Jewish voters.
Weiner ended up winning the election by 130 votes, and he was widely criticized for race-baiting. But what's really damning is Weiner's sorry/not-sorry approach to talking about the mailer after he sent it.

Anthony Weiner Gives A Strange 'Non-Denial Denial' When Asked If He's Still Sexting

Is there anyone that New York City mayoral candidate Anthony Weiner is "sexting" currently?
That was the question posed to him by New York Daily News columnist Denis Hamill in an interview published Tuesday. And Weiner responded with a classic "non-denial denial," tiptoeing around a firm answer.
"You can quibble about beginnings, middles and ends but what we're talking about is over a year ago," Weiner said.
Hamill didn't follow up on that non-denial denial. What we've been talking about, of course, is the latest round of revelations about Weiner's online sexual relationships that has spilled out over the past week.
Weiner admitted last week to online sexual relationships with at least three women after resigning from Congress in 2011. In total, he estimated that he had online relationships with between six and 10 women both during his time in Congress and otherwise.
Weiner announced on Sunday that amid the scandal, his campaign manager, Danny Kadem, had quit.

After more than 26 months, 50 court hearings and countless breathless column inches from journalists worldwide, it took just four minutes for the sentence that Silvio Berlusconi had feared to be delivered. At 5.19pm, before a fascist-era sculpture showing two men struck down by a towering figure, the judges swept into the courtroom and pronounced their damning verdict for Italy's longest-serving postwar prime minister. By 5.23pm, it was all over. At the culmination of a trial that helped strike the final nail in the coffin of the playboy politician's international reputation, the judges found Berlusconi guilty both of paying for sex with the underage prostitute nicknamed Ruby Heartstealer and abusing his office to cover it up. They even went beyond the prosecutors' sentencing requests, ordering him to serve seven – rather than six – years in prison and face a lifetime ban on holding public office. Perhaps fittingly for a case that cast a spotlight on the murky nexus of sex and power that prosecutors argued was at the heart of his premiership – in which young women were procured, they said, "for the personal sexual satisfaction" of the billionaire septuagenarian – all three judges were female. Berlusconi, who had been predicting the verdict for weeks as the logical result of his lifelong "persecution" by leftwing prosecutors, has always denied the charges and now has the right to lodge not one but two appeals. The sentence will be enforced only if these fail and it is made definitive, a process that could take years. Regardless of whether it is eventually upheld, Berlusconi is highly unlikely ever to go to jail. There were some notable absentees in court on Monday: Ilda Boccassini, the formidable prosecutor who had led the case against the 76-year-old, and Karima el-Mahroug, the former nightclub dancer from Morocco whom Berlusconi was convicted of paying for sex in 2010 when she was 17, below the legal age of prostitution in Italy. Former Italian prime minister Silvio Berlusconi claims he is "utterly innocent" after being found guilty of paying for sex with an underage prostitute. The 76-year-old was sentenced to seven years in prison and banned from holding public office by a panel of three judges in Milan. He previously denied having sex with Karima El Mahroug, also known as Ruby the Heart Stealer, after what prosecutors claimed were erotic "bunga bunga" parties at his lavish villa in 2010. "I was truly convinced I would be absolved because there was absolutely no possibility of being found guilty based on the evidence," he said. "I intend to resist the persecution because I am absolutely innocent and I don't want to abandon my fight to make Italy a truly free and just country." During his trial, the court heard dozens of young women, including Miss El Mahroug, who was 17 at the time, were paid with cash, money and cars to attend Berlusconi's parties and dance semi-naked for him. Berlusconi was also found guilty of abuse of office by arranging to have Miss El Mahroug, now 19, released from police custody when she was arrested on suspicion of theft. His defence claimed he believed the dancer was the niece of former Egyptian president Hosni Mubarak and wanted to avoid a diplomatic incident. His lawyer, Niccolo Ghedini, confirmed an appeal would be lodged, describing the sentence as "beyond reality" and "completely illogical". "The judges even went beyond the prosecutors' request (for a six-year sentence)," he added. Berlusconi has always insisted he is being persecuted by judges as part of a political plot.
