An Egyptian prosecutor on Sunday accused the ousted Islamist president of passing state secrets to Iran's Revolutionary Guard, the first such explicit detail in an ongoing espionage trial.
If convicted, Mohamed Morsi could face capital punishment. He already stands accused of a string of other charges, some of which also carry the death penalty, levelled as part of a crackdown on his Muslim Brotherhood group after the military deposed him last summer.
At Sunday's hearing, part of which was aired on state television, the prosecution accused Morsi and 35 other Brotherhood members of conspiring to destabilize the country and cooperating with foreign militant groups – including Palestinian Hamas and Lebanon's Hezbollah.
The case's chief prosecutor, Tamer el-Firgani, said Morsi, his aides and senior Brotherhood members had "handed over secrets to foreign countries, among them national defense secrets, and handed over a number of security reports to the Iranian Revolutionary Guard in order to destabilize the country's security and stability."
El-Firgani, divulging details of the charges, said national security reports meant for only Morsi to see were emailed to some of these foreign militant groups. One report, he said, was sent to the Iranians about the activities of Shia Muslims in Egypt. Iran is mostly Shia.

Lawyers for deposed Egyptian President Mohammed Morsi have walked out of his trial on charges of espionage and conspiring to commit acts of terror.
The trial has now been adjourned until 23 February.
The lawyers withdrew in protest at Mr Morsi and other defendants being confined in a soundproofed glass cage.
The Islamist former leader is facing four separate trials, three of which have now opened.
Mr Morsi was brought to Cairo's police academy on Sunday morning by helicopter from the Burj al-Arab prison where he is being held.
In this trial, he and 35 others are accused of working with Lebanese and Palestinian groups to carry out attacks in Egypt.
Mr Morsi has been put in the soundproof cage in recent appearances to prevent him shouting and disrupting proceedings.
The defendants have said they cannot follow proceedings because of the cage, but the judge insisted that headphones installed inside the dock will allow them to listen.
The cage allows the judge to control when the defendants are heard.
At one point when he was audible, Mr Morsi said: "What are you so afraid of? Are you afraid because you have no public support?" Reuters reports.
The court said it would appoint a new defence team.

Morsi defiant Mr Morsi was ousted by the military last July following mass street protests against his rule.
Since Mr Morsi was ousted there has been a severe crackdown on his Muslim Brotherhood group, as well as on other activists seen as hostile to the military-backed government.
The Brotherhood has been declared a terrorist organisation and authorities have punished any public show of support for it.

'Most probably, Morsi will be convicted' - expert

As Egypt's ousted President Mohamed Morsi appeared in court on Sunday for the first hearing of the case in which he is charged on espionage and terrorism counts, Abdelwahab El-Affendi, Political Scientist at the University of Westminster and a specialist on Islam, Middle East politics and Democracy, explained in an interview to the Voice of Russia on what legal grounds Morsi cannot be brought to trial as executive president and why he thinks the court "would have to convict him".

How do you think this trial is going to end for Mr. Morsi? Will Morsi be convicted?
Most probably, yes, I think. Because this story is no longer a legal matter. If the legal rules were observed Morsi cannot be brought to trial as executive president and yes, he has his immunity but he has been arrested first before any charges and then the charges were being brought as he was arrested which indicates that if a court accepts these procedures this means that the court would then do the biding of whoever in power at the time is officially. So if they haven't observed the law in the first instance they would have to convict him.
Sunday’s trial is one of four prosecutions that Morsi has had to face. Can you comment on the reason that we have seen so many trials? Why hasn’t it just been one trial against Morsi? Why is it so many steps in this process of prosecuting?
I think they are groping in the dark, they want something to stick. For example, this charge that a person has escaped from prison during the revolution is rather ridiculous, because there are hundreds of thousands of prisoners who left at that time, none of them were facing trial, some of them are actually in parties which are the parties who support the government. Secondly, how can you charge the president of dealing illegally with foreign entities? Usually the president of the republic is the person who decides foreign policy and is the person who legally can decide who is going to talk to or not to talk to. Anybody else has not been authorized by the president to discuss matters with foreign power could be trialed if he wanted to do that in ways which are harmful to national security or against the law. But there is no law which says that the president for example cannot talk to Hamas or cannot talk to Hezbollah or not talk to anybody else. To charge the president with espionage for talking to whoever he decides is certainly assuming that there is an authority other than the president or above the president which can tell him how to conduct his foreign policy. So all the other charges are also problematic. It is really kind of theater more or less.

The fact that the phrase sounds antique should warn us of the scale of our folly. We have lost, given away, pawned the power we once claimed. We have ceased to be who we once were. Or at least who we claimed and hoped to be – The People. Now who are we? The Consumer?  The Unemployed. The Unwanted?  ”We, the Unwanted” does not have the same ring about it does it? And yet that is what we are fast becoming. It is time to chose. Sit in front of your television or computer screen and let it sooth you, until one day you too find you have have become one of the unheard, unlamented, Unwanted. Or reach out to others and grasp hold.
It is surely time that we re-assert what the phrase “We, The People” once meant. It is suybolic I know. But symbols are powerful. And the powerful fear them.
For too long now we have been supine, docile and cowed. There have been sputterings of resolve when a million people took to the streets to oppose the War in Iraq. But the rulers of the day ignored us and ‘the people’ simply went home vaguely disquieted, perhaps a little hurt at being ignored but mainly just confused as to what to do next – if anything.
For decades now we have let others have the initiative, let others define what was acceptable and legitimate. When it was never their position to do so. This must stop.
Once, a certain people declared, “No taxation without representation.” It was and still is a simple idea. You may not tax me unless you represent my interests. Only those with my interests in mind may ask me for taxes. Today that definitiion of democracy has withered and been quietly replaced by another similar sounding but actually radically different version – I would say perversion – of democracy. Today we are taxed by people who represent every interest but ours. They are still representatives but not of our interests. Democracy has now become a kind of opera – more and more lavish in direct proportion to its separation from ordinary people and their lives.  Every four or five years we get to chose between two teams who represent some interest which is not ours. They may represent the interests of bankers, or global corporations, or militarists and the industrial complex which gets rich from their adventures, or some other grouping within the machinery of the State, or the intersts of a powerful global 1% – whatever interest they serve it is never yours and mine. For those who will clamour and say the Democrats or Labour or La Gauche represent the interests of the labour unions, WAKE UP!  It’s been decades since that was even partially true. Labour under Blair and Brown was Thatcherism by another name and ignored a million people who said very clearly and en masse, that the Bush/Blair war was unjust, illegal and unwanted. The Democrats under Obama followed the same financial and economic ideology as Bush, even chosing the same people to run things, and was as warlike and arrogant as well. Change? Tell it to a moron. He might believe you.
Democracy is broken. No one represents us. We are allowed only to chose between different teams of The Entitled who, once chosen, ignore us completely. The whole idea of a mandate has mutated. Once that idea meant that a government could do what it had said it would do when it was trying to win our votes. Beyond those things, it had to consider ‘The People’.  Today all parties consider that being elected means to be handed absolute power to do whatever they feel like doing, whatever they can ram through the tattered remains of accountability and oversight.
Elected dictatorship in installments is what we have today.  And when each installment, no matter the different names and colours of the teams, is almost indistinguishable from the last, what is representative democracy if not a street parade of oversized cartoon characters and their pantomimed arguments. Are we not amused?
If we do not speak up soon we will find when we finally do, nothing is heard but grunting and bleating. We are, to borrow a phrase from the brilliant Roberto Callaso, already walking through a vast slaughter house. And those who run it have no good intent.
It is past time when we must revivify what We the People means. We must stop reacting like frightened animals and take the initiative.We cannot allow those who presume to rule over us to continue to tell us what ‘must’ be done and to over-rule all debate by  insisting ‘there is no alternative.’ We must state what We the People will accept and what we won’t, what we regard as legitimate and what is not. It is for us to decide these things not them. It may seem like just words and on one level of course it is. But it was only words when it was said the first time. What those words did the first time and can do again, is to stop our rulers’ proclamations always being against a blank and passive background. Simply by declaring what We will and won’t tolerate or accept we force their proclamations to appear as what they are – aggressive, partisan and debateable.

Does the Left Have a Future?

This week I spoke with John Stauber, an investigative journalist, author, founder of Center for Media and Democracy, and most recently a  self-professed outside agitator, on the benefits of voting two party.
In an article you wrote for CounterPunch back in March, you zeroed in on the “Progressive Movement” a democratic money and propaganda machine/echo chamber run by liberal elites like OFA, Mother Jones, Van Jones, The Nation, and largely MoveOn.org to name a few who sometimes fool progressives into supporting corporate causes and have co-opted messages from OWS to appear populist. Considering the far right has the left beat in the messaging game, how successful has the professional left been at advancing their neoliberal agenda on a larger scale? Are liberals really buying it?

A. These terms — progressives, liberals, left, populist, far right, neo-liberal — have different meanings for different people. I like to keep things simple and get back to basic principles and terms like democracy, individual rights and liberties, corporate power, concentrated wealth. The situation today is this: both the Democratic and Republican Parties represent the interests of the most powerful corporate elite in America. Neither party will ever represent the fundamental radical democratic changes we need to take wealth away from the small percentage who have concentrated it in their hands, and to empower people in a democracy. Let me repeat that: neither party will ever serve economic and political democracy.
The so-called “progressive movement” is made up of corporations run by paid staff and contractors who believe that the key to the future is to defeat the corporate Right, the Republicans, in elections. They believe that their own elite-funded propaganda campaigns on behalf of the environment, social justice, human rights, anti-monopoly politics, unions, can mobilize a public that can move the Democratic Party as a whole in this direction. That’s a farce and a fraud.
The crises facing us — poverty, ecological devastation, increasing concentration and power in the hands of the super rich and their economic institutions — are simply worsened by both corporate Parties, and those Parties run on elite wealth and massive propaganda. They are fully supported by all the established institutions of the society, including the corporate media.
But of course those of us who are radicals outside the corporate political parties are depicted as friends of fascism and the far right when we refuse to lend our support to electing Democrats. That will always be the case. And the extremely articulate and financially well rewarded pundits, flacks, and hacks of the professional “progressive movement” are dependent on the myth of two-party “democracy” to pay their bills, put their kids through school, buy houses, appear on TV, sell their books, and further their careers. They need deeply to believe this myth of American Democracy being advanced best through the Two Party system, because if they didn’t they’d be lousy at their jobs and would have a hard time living with themselves. It’s the cognitive dissonance of the salespeople; if you stop believing in the car or shoes or whatever you are peddling, you won’t be very good at selling it. So, they believe!
The problem we face is simple. It is the capitalist corporate economic system itself that is destroying the very ability of the planet to sustain life. Massive global poverty, super concentrated wealth and power, mindless consumerism, final destruction of the biosphere’s ability to sustain the industrial civilization — these are not issues that will be solved by the “professional progressives” with their clicktivism, talking points, game changing PR campaigns, and their support for reform via the existing political establishment. The evil shit is going to just continue to hit the fan, with no effective mobilized response because the professional reformers and their big NGOs suck all the air out of the room, and pose as a viable path to change. They are not.
Hillary Clinton is playing coy about her eventual presidential run in 2016 by saying,  “I will look carefully at what I think I can do and make that decision next year.” Like Obama, she talks the talk but doesn’t walk the walk and like Obama’s skin color, her gender is a driving force behind propelling her back into the White House. What can we expect from a female President Clinton?

A. Nothing will come from any Clinton but more of the same concentration of wealth and power in the hands of the corporate elite. Spying, war, destruction of the main street economy is what we can expect. But of course the billion-dollar sales pitch will be, “save our country from the Tea Party extremists, elect the first woman president!” It might work to get her elected, but don’t expect change.
Elizabeth Warren and Hillary Clinton appear to be polar opposites, 99% vs 1%. Can Warren’s passion for economic justice rebrand and revive the long-dead democrat party? She’s got the brains and influence but given her defense of Obama and the Clintons at last year’s DNC, I highly doubt it.
A. Nothing can “revive” the Democratic Party. Democratic “progressives” promote this myth that somehow “we” can “take back” the Party of the people and need saviors like Elizabeth Warren to do it.

Since President Obama signed the Affordable Care Act into law, he has changed it five times. Most notably, he suspended the employer mandate last summer. This is widely known, but almost no one seems to have grasped its significance.
The Constitution authorizes the President to propose and veto legislation. It does not authorize him to change existing laws. The changes Mr. Obama ordered in Obamacare, therefore, are unconstitutional. This means that he does not accept some of the limitations that the Constitution places on his actions. We cannot know at this point what limitations, if any, he does accept.
By changing the law based solely on his wish, Mr. Obama acted on the principle that the President can rewrite laws and—since this is a principle—not just this law, but any law. After the crash of Obamacare, many Congressmen have implored the President to change the individual mandate the same way he had changed the employer mandate, that is, to violate the Constitution again.
The main responsibility the Constitution assigns to the President is to faithfully execute the Laws. If the President rejects this job, if instead he decides he can change or ignore laws he does not like, then what?
The time will come when Congress passes a law and the President ignores it. Or he may choose to enforce some parts and ignore others (as Mr. Obama is doing now). Or he may not wait for Congress and issue a decree (something Mr. Obama has done and has threatened to do again).
Mr. Obama has not been shy about pointing out his path. He has repeatedly made clear that he intends to act on his own authority. “I have the power and I will use it in defense of the middle class,” he has said. “We’re going to do everything we can, wherever we can, with or without Congress.” There are a number of names for the system Mr. Obama envisions, but representative government is not one of them.
If the President can ignore the laws passed by Congress, of what use is Congress? The President can do whatever he chooses. Congress can stand by and observe. Perhaps they might applaud or jeer. But in terms of political power, Congress will be irrelevant. Probably, it will become a kind of rubber-stamp or debating society. There are many such faux congresses in tyrannies throughout history and around the globe.
Mr. Obama has equal contempt for the Supreme Court. In an act of overbearing hubris, he excoriated Supreme Court Justices sitting helplessly before him during the 2010 State of the Union address—Justices who had not expected to be denounced and who were prevented by the occasion from defending themselves. Mr. Obama condemned them for restoring freedom of speech to corporations and unions.

A Tyrant's Dream: Congress Cedes Control Of Federal Debt

The bargain rushed through Congress on Wednesday night clobbers the U.S. Constitution. It shifts control over the debt ceiling from Congress to the president, in violation of Article 1, Section 8, and pushes the nation toward a slippery slope of allowing the president unlimited power to borrow.
Article 1, Section 8, states that "Congress shall have the Power To lay and collect Taxes ... to pay the Debts and provide for the common Defence and general Welfare of the United States; . .. To borrow Money on the credit of the United States ... "
Until 1917, the president had to ask Congress' permission for each borrowing and frequently acquiesced to conditions. That year, Congress devised the debt ceiling, which gave the president flexibility to borrow up to a certain amount in order to fund a world war.
Ever since then, presidents have come to Congress once or twice a year for a debt-ceiling hike. Until this year, Congress had never abdicated control over the nation's indebtedness.
The U.S. Supreme Court has ruled that Congress can't surrender its powers to another branch of government or change how laws are made (INS v. Chadha, 1983). But that's what the deal concocted Wednesday night does.
Instead of raising the debt ceiling, the Default Prevention Act of 2013 suspends it and shifts power to the president to determine how much the nation should borrow.
Fiscal Failing
Congress' check on borrowing is so diminished as to be laughable. It will now require a two-thirds vote — a supermajority — in both houses to "disapprove" the president's decision on what the debt ceiling should be. No real negotiating, as all previous presidents have had to do.
This is no more constitutional than if Congress ceded its taxing power to the president, telling Obama that he could impose whatever taxes he wants unless two-thirds of both houses disapprove.
The Default Prevention Act of 2013 puts the president in the driver's seat instead of Congress. It was done for the first time last January, at the urging of now former Treasury Secretary Timothy Geithner. It moves the nation dangerously close to the Democratic Party's goal of eliminating the debt ceiling permanently — a dictator's dream.

Ending the Next Debt Ceiling Crisis

It's time to eliminate the legal authority of a single House of Congress to destroy the full faith and credit of the United States. The recent crisis shows that Tea Party Republicans continue to view the debt limit as a negotiating lever to extract political concessions each time our bills come due -- repeatedly driving the country to the edge of the fiscal cliff, then leaving it up to the grown-ups to steer clear of disaster at the last second.

Yet to allow radical factions to retain their abstract right to precipitate debt-limit crises is very damaging. Investors will demand a premium on Treasury bonds to compensate them for the risk that some future stand-off will spin out of control. In the longer run, the underlying uncertainty will undermine the central position of the dollar in the monetary system, depriving the country of the great economic advantages that flow from issuing the world's reserve currency. In contrast, a decisive effort to put our house in order will establish that Washington is determined to avoid future fiascos.

This is the point of a bill I introduced that changes the rules of the debt-limit game. Under the reformed procedures, the president would announce, on an annual basis, the increase required to avoid default. Congress would retain the power to reject the president's initiative by a simple majority vote of both Houses -- and if the president responded with a veto, two-thirds majorities could still insist on ultimate control. In restricting its power to play politics on this issue, however, Congress would be redeeming the Fourteenth Amendment's command that "[t]he validity of the public debt of the United States... shall not be questioned."
