The Re-enserfment of Western Peoples

The re-enserfment of Western peoples is taking place on several levels. One about which I have been writing for more than a decade comes from the offshoring of jobs. Americans, for example, have a shrinking participation in the production of the goods and services that are marketed to them.

 
On another level we are experiencing the financialization of the Western economy about which Michael Hudson is the leading expert (Killing The Host). Financialization is the process of removing any public presence in the economy and converting the economic surplus into interest payments to the financial sector.

These two developments deprive people of economic prospects.  A third development deprives them of political rights.  The Trans-Pacific and Trans-Atlantic Partnerships eliminate political sovereignty and turn governance over to global corporations.

 
These so called "trade partnerships" have nothing to do with trade. These agreements negotiated in secrecy grant immunity to corporations from the laws of the countries in which they do business. This is achieved by declaring any interference by existing and prospective laws and regulations on corporate profits as restraints on trade for which corporations can sue and fine "sovereign"
governments. For example, the ban in France and other counries on GMO products would be negated by the Trans-Atlantic Partnership. Democracy is simply replaced by corporate rule.I have been meaning to write about this at length. However, others, such as Chris Hedges, are doing a good job of explaining the power grab that eliminates representative government.

The release Thursday of the 5,544-page text of the Trans-Pacific Partnership—a trade and investment agreement involving 12 countries comprising nearly 40 percent of global output—confirms what even its most apocalyptic critics feared.

“The TPP, along with the WTO [World Trade Organization] and NAFTA [North American Free Trade Agreement], is the most brazen corporate power grab in American history,” Ralph Nader told me when I reached him by phone in Washington, D.C. “It allows corporations to bypass our three branches of government to impose enforceable sanctions by secret tribunals. These tribunals can declare our labor, consumer and environmental protections [to be] unlawful, non-tariff barriers subject to fines for noncompliance. The TPP establishes a transnational, autocratic system of enforceable governance in defiance of our domestic laws.”

The TPP is part of a triad of trade agreements that includes the Transatlantic Trade and Investment Partnership (TTIP) and the Trade in Services Agreement (TiSA). TiSA, by calling for the privatization of all public services, is a mortal threat to the viability of the U.S. Postal Service, public education and other government-run enterprises and utilities; together these operations make up 80 percent of the U.S. economy. The TTIP and TiSA are still in the negotiation phase. They will follow on the heels of the TPP and are likely to go before Congress in 2017.

These three agreements solidify the creeping corporate coup d’état along with the final evisceration of national sovereignty. Citizens will be forced to give up control of their destiny and will be stripped of the ability to protect themselves from corporate predators, safeguard the ecosystem and find redress and justice in our now anemic and often dysfunctional democratic institutions. The agreements—filled with jargon, convoluted technical, trade and financial terms, legalese, fine print and obtuse phrasing—can be summed up in two words: corporate enslavement.

The TPP removes legislative authority from Congress and the White House on a range of issues. Judicial power is often surrendered to three-person trade tribunals in which only corporations are permitted to sue. Workers, environmental and advocacy groups and labor unions are blocked from seeking redress in the proposed tribunals. The rights of corporations become sacrosanct. The rights of citizens are abolished.

Following years of secret negotiating, the Obama administration released the text of the controversial Trans-Pacific Partnership (TPP) at 3:30 a.m. today (Thursday, November 5). Although billed as a “trade agreement,” the treaty calls for economic and political “integration” among the TPP members. Adopting the model that transformed the European Common Market into the European Union, the TPP creates regional governing structures and processes aimed at eventual convergence into a similar EU-style super-state.

Currently, the TPP's negotiating member states include the United States and 11 other Pacific Rim nations: Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam. However, as we have been reporting here for years (see here and here ), the TPP architects have long stated their plans to use the TPP as a “stepping stone” to a much larger Free Trade Area of the Asian Pacific (FTAAP) that includes China and Russia.
The newly released text confirms this goal officially. The TPP Preamble states:
The Parties to this Agreement, resolving to:

ESTABLISH a comprehensive regional agreement that promotes economic integration....
EXPAND their partnership by encouraging the accession of other States or separate customs territories in order to further enhance regional economic integration and create the foundation of a Free Trade Area of the Asia Pacific.

As Christian Gomez reported for The New American on November 4, Secretary of State John Kerry (shown above with Obama) recently invited both Communist China and Russia to join the TPP. "We invite people to come join other initiatives, like the Trans-Pacific Partnership, the TPP. We welcome China, we welcome Russia, we welcome other countries who would like to join, as long as they want to raise the standards and live up to the highest standards of protecting people and doing business openly and transparently and accountably," Kerry said in an interview with Russian interstate channel Mir TV.

U.S. Senator Jeff Sessions (R-Ala.) has wasted no time in sounding the alarm over the massive Trans-Pacific Partnership (TPP), which the Obama administration unveiled to the public and Congress on Thursday.

The enormous agreement (over 5,500 pages), which had been negotiated over the past several years in strictest secrecy and kept tightly under wraps until now (see here  and here), “confirms our fears,” said Sessions, who chairs the Senate Judiciary Committee’s Subcommittee on Immigration and the National Interest.

“The text of the Trans-Pacific Partnership runs 5,554 pages,” declared Sessions, in a statement issued Thursday, soon after the release of the text. “This is, by definition, anti-democratic,” he charged. “No individual American has the resources to ensure his or her economic and political interests are safeguarded within this vast global regulatory structure.”

 
According to Sessions: “The predictable and surely desired result of the TPP is to put greater distance between the governed and those who govern. It puts those who make the rules out of reach of those who live under them, empowering unelected regulators who cannot be recalled or voted out of office.  In turn, it diminishes the power of the people’s bulwark: their constitutionally-formed Congress.”
Sessions, who has been one of the most trenchant critics of the TPP among Republicans in Congress, has repeatedly pointed out that hidden under the verbiage about trade and jobs, the TPP amounts to the instigation of an entirely new governance system, one that would gradually supplant our own. “Among the TPP’s endless pages are rules for labor, environment, immigration and every aspect of global commerce — and a new international regulatory structure to promulgate, implement, and enforce these rules,” he warns. “This new structure is known as the Trans-Pacific Partnership Commission — a Pacific Union — which meets, appoints unelected bureaucrats, adopts rules, and changes the agreement after adoption.”

‘TTIP is death:’ Over 100 arrested in Brussels at US-EU trade deal protest (VIDEO)

At least 100 people have been arrested in Brussels, where hundreds more protested against TTIP, an impending free trade deal between the US and the EU, as the next round of TTIP talks approaches.

Roads were paralyzed in the Belgian capital as a force of more than 600 activists descended on EU headquarters, blocking traffic and the venue of the EU leaders summit in protest against the Transatlantic Trade and Investment Partnership (TTIP).


People carried signs and chanted slogans such as “Stop TTIP, stop austerity” and "Sorry for the inconvenience. We're trying to save the world," at the march in Brussels on Thursday. "TTIP is death" another sign read. One group of protesters displayed a balloon ‘Trojan Horse’ as an allegory for the deal.

Last week, WikiLeaks released the final text of the TPP’s intellectual property rights chapter and it is absolutely terrifying.

These are just a few of its most dangerous pieces:

  • Compel ISPs to take down websites without any sort of court order, just like SOPA. (Appendix Section I)
  • Extend the US’s copyright regime to require copyrights stand for life plus 70 years, preventing anyone from using works that belong in the public domain. (Article QQ.G.6)
  • Criminalize whistleblowing by extending trade secrets laws without any mandatory exemptions for whistleblowers or investigative journalists. (QQ.H.8)
  • End anonymity online by forcing every domain name to be associated with a real name and address. (Article QQ.C.12)
  • Make it illegal to unlock, modify, or generally tinker with a device you own. (Article QQ.G.10)
  • Export the US’s broken copyright policies to the rest of the world without expanding any of the free speech protections, like fair use. (Article QQ.G.17)
The worst part is that this is just one of the TPP’s 30 chapters.

 
For years, governments have held critics of the massive Trans-Pacific Partnership agreement in a perfect catch 22. Officials brushed off public outcry and concern by claiming that the dissenters didn’t have all the facts.
This was by design—the 12 country trade deal was negotiated entirely behind closed doors by industry lobbyists and government appointees, and even now the text of the agreement is still classified.

But late last week, WikiLeaks released the final text of the Intellectual Property chapter, meaning those excuses won’t work anymore.

We’re planning to go all out against the TPP, but the first step is to make sure Congress knows just how many people oppose the TPP.

 
Taking action today is just the beginning, because if all we do is send emails and make phone calls, Congress is not going to reject the TPP. Too many giant industries are seriously invested in making sure Congress ratifies the TPP.

If we’re going to win, we need to go big. Which is exactly what we’re going to do.

So take action right now. Contact your Congresspeople now and tell them to vote against the TPP. Then get ready to do more because we’re going to unleash some of our strongest campaigns ever.

Already we have plans to work with hundreds of different groups as a massive coalition to fight the TPP, coordinate gigantic on-the-ground protests in key cities across the country, and produce compelling content to spread the word to as many different audiences as possible just what is at stake in the TPP.

'We Are Writing the Rules,' says Obama. Who's 'We'?

The negotiations and the sales push behind Washington's latest (and biggest) "free trade" agreement amounts to Kabuki theater.

What theater? Kabuki. It's a 17th-century form of Japanese drama, featuring elaborate sets and costuming, rhythmic dialogue and stylized acting and dancing. That does, indeed, nicely sum up the White House's production of the Trans-Pacific Partnership: Its negotiations have been set in luxury resorts around the world, covered by elaborate secrecy; insiders wear the costumes of global corporate power; trade officials parrot rhythmic dialogue about high standards and incredible benefits for all. And the president himself is the main actor, dramatically proclaiming that TPP is "the most progressive" trade deal ever, and now he's doing a stylized political dance in hopes of winning congressional approval.

What a phenomenal show!

But it doesn't seem to be selling. Recent polls show broad public opposition to any more of these same old trade schemes, not only among Democrats, but independents and Republicans, too. Ten of the 2016 presidential candidates are against the deal. The counter movement is led by Democratic contender Bernie Sanders, who calls it flat-out "disastrous," and by GOP frontrunner Donnie Trump who dubs it "a horrible deal." Even corporate darling Carly Fiorina is "very uncomfortable with this deal." Congressional opposition is strong, and even Ford Motor Company — which was one of the corporate giants allowed inside the negotiations — has blasted it, calling on Congress to vote no.

We have just witnessed one of the most significant steps toward a one world economic system that we have ever seen.  Negotiations for the Trans-Pacific Partnership have been completed, and if approved it will create the largest trading bloc on the planet.  But this is not just a trade agreement.  In this treaty, Barack Obama has thrown in all sorts of things that he never would have been able to get through Congress otherwise.  And once this treaty is approved, it will be exceedingly difficult to ever make changes to it.  So essentially what is happening is that the Obama agenda is being permanently locked in for 40 percent of the global economy.

The United States, Canada, Japan, Mexico, Australia, Brunei, Chile, Malaysia, New Zealand, Peru, Singapore and Vietnam all intend to sign on to this insidious plan.  Collectively, these nations have a total population of about 800 million people and a combined GDP of approximately 28 trillion dollars.

Of course Barack Obama is assuring all of us that this treaty is going to be wonderful for everyone
In hailing the agreement, Obama said, “Congress and the American people will have months to read every word” before he signs the deal that he described as a win for all sides.
“If we can get this agreement to my desk, then we can help our businesses sell more Made in America goods and services around the world, and we can help more American workers compete and win,” Obama said.
Sadly, just like with every other “free trade” agreement that the U.S. has entered into since World War II, the exact opposite is what will actually happen.  Our trade deficit will get even larger, and we will see even more jobs and even more businesses go overseas.

Trans-Pacific Partnership Deal Struck As "Corporate Secrecy" Wins Again

Once again the corporatocracy wins as the so-called "Trojan horse" Trans-Pacific Partnership (TPP) trade agreement has been finalized. As WSJ reports, the U.S., Japan and 10 countries around the Pacific reached a historic accord Monday to lower trade barriers to goods and services and set commercial rules of the road for two-fifths of the global economy, officials said.
For the U.S., the TPP (reportedly) opens agricultural markets in Japan and Canada, tightens intellectual property rules to benefit drug and technology companies, and establishes a tightknit economic bloc to challenge China’s influence in the region (likely forcing their hand into separate trade agreements).

However, Obama is likely to face a tough fight to get the deal through Congress(especially in light of presidential candidates' opposition).


The US, Japan and 10 other Pacific Rim economies have reached agreement to strike the largest trade pact seen anywhere in two decades, in what is a huge strategic and political win for US President Barack Obama and Japan’s Shinzo Abe.

‘Massive’ Media Hype for TPP

 
It is amazing how the elite media can be dragged along by their noses into accepting that the Trans-Pacific Partnership (TPP) can have a big impact on trade and growth. If I had a dollar for every time the deal was described as “massive,” or that we were told what share of world trade will be covered by the TPP, I would be richer than Bill Gates. The reality is that the vast majority of the trade between the countries in the TPP is already covered by trade agreements, as can be seen:

We continue to hear superlatives even as the evidence suggests the trade impact will be trivial. For example, the New York Times reported that US tariffs on Japanese cars will be phased out over 30 years. Wow! The most optimistic growth estimates show a cumulative gain by 2027 of less than 0.4 percent, roughly two months of normal GDP growth.

This doesn’t mean that the TPP can’t have an impact. It will lock in a regulatory structure, the exact parameters of which are yet to be seen. We do know that the folks at the table came from places like General Electric and Monsanto, not the AFL-CIO and the Sierra Club. We also know that it will mean paying more for drugs and other patent and copyright-protected material (forms of protection, whose negative impact is never included in growth projections), but we don’t yet know how much.

We also know that the Obama administration gave up an opportunity to include currency rules. This means that trade deficit is likely to persist long into the future. This deficit has been a persistent source of gap in demand, leading to millions of lost jobs. We filled this demand in the 1990s with the stock bubble and in the last decade in the housing bubble. It seems the latest plan from the Fed is that we simply won’t fill the gap in this decade.

Revolving Door: MPAA Hires Chief USTR Negotiator Behind ACTA And TPP's IP Chapter

For the past five years or so, the USTR's chief intellectual property negotiator has been Stan McCoy. McCoy has long positioned himself as an intellectual property maximalist, repeating talking points from lobbyists regularly, while condescending to anyone who questions the legitimacy of those claims. McCoy famously was the chief negotiator behind the US's disastrous (and mostly failed) attempt to push ACTA through, as well as the lead on the TPP's intellectual property chapter -- a chapter so bad it may help sink the TPP agreement. In fact, previous reports have noted that McCoy's bullying and aggression in trying to push through the TPP were angering others in the negotiations. McCoy also has a long history of mocking public interest advocates, while praising maximalists for similar tactics. From a report a few years ago concerning a hearing that McCoy chaired:
The burden of proof was very obviously on the public interest, civil society groups. Stan McCoy of the USTR, who was presiding over the hearing, joked about the two-phonebook-sized submission by the International Intellectual Property Alliance. (Lol?) Sadly, there is no independent verification of these industry reports and there were no tough questions for industry regarding their testimony. Several times, McCoy interrupted civil society groups’ testimony to chide them on speaking too generally about IP policy, but refrained when industry witnesses did the same.
Given all that, it should be no surprise at all that McCoy, the failed strategist behind ACTA and the TPP's IP provisions... has received his reward and pat on the back from the industry: a shiny new job at the MPAA. As Tim Lee notes in that link, this is just the latest in the never-ending revolving door between maximalist lobbying groups and the USTR:
Last year I wrote that at least a dozen former senior USTR officials have moved to industry groups that favor stronger protections. McCoy's hire makes it a baker's dozen. Previous hires include including Greg Frazier, who (according to his LinkedIn page) spent 8 years as the executive vice president of the Motion Picture Association of America after a stint at USTR. Other former USTR officials took jobs at drug and medical device companies.

A controversial trade deal being touted by the White House is expected to give American corporations broad new authority if approved. Now according to newly released documents, big banks gave millions to the execs that are now orchestrating the agreement.

Investigative journalist Lee Fang wrote for Republic Report on Tuesday this week that two former well-placed individuals within the ranks of Bank of America and CitiGroup were awarded millions of dollars in bonuses before jumping ship to work on the Trans-Pacific Partnership on behalf of the White House.
The Trans-Pacific Partnership, or TPP, is a widely-contested trade deal between the US and 11 other nations adjacent to the Pacific Rim, and has been negotiated by representatives for those countries in utmost secrecy. According to leaked excerpts of the TPP and remarks from experts following the news closely, though, it’s believed that the arrangement would allow corporations to oppose foreign laws while at the same time limiting the abilities for governments to regulate those entities.
On Tuesday, Fang wrote that two major United States-based financial firms have significantly awarded former executives who have since attracted the attention of President Barack Obama and subsequently been offered positions that put them directly involved in TPP talks.
Former Bank of America investment banker Stefan Selig, Fang acknowledged, received more than $9 million in bonus pay after he was nominated to join the Obama administration in November. And Michael Froman, the current US trade representative, was awarded over $4 million from Citigroup when he left them in 2009 in order to go work for the White House. Republic Report were provided those statistics through financial disclosures included in Fang’s article.
When Selig was asked to head the International Trade Administration by the White House last November — a Commerce Department job — the New York Times considered it “a rare appointment of a Wall Street banker by the Obama administration.” If he is confirmed by the Senate as expected, he will work directly with US trade officials on hammering out final arrangements for the TPP. Froman has been the US trade representative since last June, and according to his biography on that department’s official website, is directly overseeing TPP discussions.
